HIPAA, an acronym for the Health Insurance Portability and Accountability Act, was signed into law on August 21, 1996, Public Law 104-191. This law impacts all areas of the health care industry and was designed to provide insurance portability, to improve the efficiency of health care by standardizing the exchange of administrative and financial data, and to protect the privacy, confidentiality and security of health care information.

HIPAA has been called the most sweeping piece of healthcare legislation since Medicare. Compliance with final HIPAA regulations requires a coordinated effort among the various constituents of a healthcare organization, including information systems.

Claimsnet is committed to meeting HIPAA requirements and helping our customers successfully meet HIPAA requirements. Program Overview

Claimsnet's HIPAA compliance program development is occurring in four steps: strategic planning, business assessment and risk analysis, response, and remediation.

Step 1. Strategic Planning

We have identified the management structure, resources, and checkpoints necessary to manage the complexities of HIPAA implementation. We have established a HIPAA team with defined roles and responsibilities to minimize the potential for redundant or inconsistent efforts across our organization. We have prepared an effective HIPAA plan to ensure that HIPAA is part of our overall corporate strategy.

Step 2. Business Assessment and Risk Analysis

We have performed an analysis of our business operations to assess the risks and impact of HIPAA on our organization. Utilizing the HIPAA resources and other healthcare business partners has provided the foundation to develop initial solutions, identify related opportunities, and establish cost and resource requirements. Business assessment and risk analysis are the foundation for a comprehensive HIPAA compliance program.

Step 3. Response

We have determined how the components of HIPAA (Transactions, Privacy and Security) apply to Claimsnet in terms of product capabilities, internal operations, customers and business partners, and the overall business impact. We have identified ways to improve our business processes and facilitate ongoing compliance with HIPAA regulations. Response development will be our road map as we move from assessment to remediation.

Step 4. Remediation

In the final step we work to reduce our organizational risks and make the necessary changes to carry out our HIPAA compliance program. This step occurs at the department level where the "heavy lifting" of implementing HIPAA compliant policies and procedures occurs. We are implementing processing changes, new policies and procedures, and recommending future changes for ongoing HIPAA compliance.

Our goal is to be operational for HIPAA-compliant claims transactions prior to the compliance date of October 26, 2002.

Education Program

In each step, Claimsnet.com uses its healthcare operations knowledge to design and deliver HIPAA compliance education programs including executive management education, organizational awareness, and customer awareness. These educational programs are designed to meet the needs of our employees and customers.

 Business Associate

A Business Associate is defined by the Department of Health and Human Services as "...a person to whom the covered entity discloses protected health information so that the person can carry out, assist with the performance of, or perform on behalf of, a function or activity for the covered entity."
